    Choosing your closing agent is one of the most important decisions involved with a vacation property purchase. Follows is a list of closing agents that have received multiple recommendations from past clients. It’s also advisable for a buyer to contact the resort being purchased directly, as they may also offer additional recommendations for you to consider. You may also want to contact your own legal counsel, or a real estate attorney practicing in the state where the property is located. This list is reviewed and updated quarterly.       I've been informed that currently, Resort Title Agency is no longer accepting owner to owner transfers for Bluegreen Vacation Club ownerships, but is referring those to PCS Title for processing. I've left a message for RTA to confirm, but have not gotten a return call to date.

          Who do you use in Mexico? I am trying to find out for selling a timeshare there. Do you need one there?

            Susan and Tia have been in the business a long time.. They are both very familiar with most timeshares in Mexico and should do a great job for you. (note added 11/21/2010: Susan Gale has now left Timeshare Transfer, Inc to start her own closing business- Express Timeshare Closings, Inc.)

            With most non-deeded international memberships, you aren't required to use a closing company if the ownerships are not deeded. I, however- always recommend a good third party closing agent (not party to the transaction) be used for every transfer. It just gives you a professional set of eyes to ensure everything goes smoothly.

            With that said, you will also want to check with your resort to determine the required transfer procedure. You may find it to be a fairly simple process- and if your buyer trusts you- one that you can handle on your own.

                  Kudos to Julie.. When she was in charge of Stewart's non-escrow closings (This means that they handled the doc prep and processing but not escrow or closing statements- often other closing agents would use this service to close resorts in areas they were not licensed in or if they were simply unfamiliar with the transfer process for that specific resort. She was often invisible during the transaction, but if she knew you she would sometimes let you know she was handling the transfer!) I dealt with her from time to time and always found her to be extremely knowlegable as well as efficient.

                  *For those unfamiliar with Stewart's timeshare division, the escrowed closings were done under the name Intercity Escrow and Title out of California.

                    Are documents prepared by all of your recommended agents in compliance with state laws? For example the laws in many states that make it a criminal offense for someone other than an attorney licensed in the state where the timeshare is located to prepare deeds, and a felony if money changes hands? I know one of the firms that you recommend, PCS Title, does indeed fully comply with all such state laws but I am not familiar with some of the others. I do know of a number of closing companies not on your list which use laymen in another state to prepare deeds and very often screw them up because they don't know all the nuances in real property law from state to state. I am also aware that a number of such out of state companies that have prepared NC timeshare deeds have been issued cease and desist letters by the NC State Bar, the last step before criminal prosecution.

                    For example, for North Carolina, a state that is very serious about enforcement of the laws on unlicensed practice of law, you list Warner, Smith, and Harris, an Arkansas law firm, Timeshare Title, Inc., Timeshare Resale Closing Company, and PCS Holdings. I am aware that PCS does have properly licensed attorneys they associate to prepare deeds in all the states it closes timeshares in, but the others, I am not certain about. I did look at the website of the Arkansas law firm and note that the only states its own attorneys are licensed in besides Arkansas itself are Oklahoma and Minnesota. Maybe they associate an attorney in North Carolina to prepare deeds like PCS does, but nothing on their website shows that one way or the other. Timeshare Title's website implies that they use an out of state attorney to ''review'' their deeds but it is not totally clear. If that is the case, then they would likely be operating unlawfully for states like North Carolina. An internet search does not turn up a website for Timeshare Resale Closing Company.

                      This list is simply a compilation of data from a closing experience survey that asks for the name of the closing agent they used and whether the client would recommend that company to others. No attempt is made to vet the companies on the list, other than the criteria that they must have received at least five recommendations and receive lower than a 10% ratio of negatives.

                      This list hasn't been updated in quite a while, but I hope it still provides some direction for people who need a decent closing agent.

                      Before choosing a closing agent, the client should always contact a few companies and request a specific quote. It's also sometimes a good idea to contact the resort management company and ask if they have any recommendations. The closing agent should always operate a true escrow account (not simply work from an operating account that is not subject to oversight or routine reconcilliation) and should always be familiar with the resort in question. I also normally recommend that the client request information to confirm that the closing agent is either licensed in the state where the property is located, or is affiliated with a local attorney or title agent.

                        Someone buying or selling a timeshare should also verify that the person preparing the deed is licensed to practice law in the state where the timeshare is located. If not, many states have remedies such as this one:

                        I would also say that it is always (rather than just sometimes) a good idea to call the resort and ask for a recommendation of a local attorney who handles timeshare closings. Often the fee is not much different from these out of state closing mills, and you are almost certain to get competent service. I have seen far too many defective and even invalid deeds recorded by these out of state timeshare closing mills.
