    Unhappy Ebay timeshare purchase HGVC Hi Bay club

    Yes I'm a newby; Bought a HGVC everyear 7000 bay club HI 8/3/2011 from IA Vacations on EBay. Paid by credit card, signed contract. Now all we have is emails! Every stupid excuse from them you can imagine. Very vage info in emails. I disputed the charge with c card co last week, now need to send them info per letter received today. No problem I saved all emails. Started looking on internet, IA uses other names, sells and buys TS, lots of complaints, I KNOW, now I look! Any advice or anyone had a similar experience with this company. Does contacting Ebay do anything? Have not heard a word from IA since 11/3. Last email said they had to send paperwork back to HI reconvaynce due to a missing page? Checked HI reconvayence site, nothing recorded in our name as of today. I would really appreciate any advice or info from others regarding IA Vacations on a EBay purchase. THANKS

    It wouldn't hurt to contact EBAY. Make sure you use the word fraud. You might also want to talk to the attorney general in the state IA is located and perhaps even try contacting the FTC.

    Unfortunately I don't think ebay is going to be much help and since you paid by credit card and not paypal, you'll have to probably go thru your credit card company. Not that paypal would be that helpful anyway.

    You have my sympathy. I purchased through them and it took many months, a complaint to the BBB and dealing with the resort and the resort constantly calling them as well.

    It will take MONTHS for the sale to go through. It seems that they are renting out any unused weeks before they finish closing the sale. If you file a BBB complaint in their area, they will call you the next day. Good luck.

    I'm not familiar with the company, but fwiw HI is notoriously slow when it comes to getting the deeds recorded.

    I hope this works out for you.

    Thank you all for your replies. Hopefully the credit card company is going to come through. They stated if you pay for a product and don't receive the product the charge (payment)can be removed (let's hope). I just need to send them emails from IAVactions aka Alltimeshares aka Property Relief aka Redweek aka..... I will contact AG in Tennesee and the BBB in TN.
    Funny though, the credit card co said they would contact the merchant and I have still not heard from them since 11/3. I'll let you all know how this works out might help someone else who is bidding on a TS on EBay

    Not all are bad, I have used resort Closing many times, 90 days turn around.

    My last (deeded) closing took a week, the current one is being handled by a turtle speed closer, and nothing happened in the first two weeks, except for their attempt to collect from me twice.

    When did you purchase from them? I just know they are stringing us along and my gut says this is not good It has now been 4 1/2 mths! Did you contact HGVC the corp or the actual resort? Would HGVC have any info on the pending purchase. I was told by IA FirstRightOfRight was cleared by HGVC, but I am now not sure even if that is true>Do you think the county recorders office in HI would give me any info, like do they have any paperwork (deed or pending deed) with our name filed by IA? I looked on HI recorders office web site last night, nothing in our name has been recorded as of 12/8. Our pts for the TS are available 1/1/12.     One problem with eBay purchases is that most sellers will require using their closing company, even if that company is not legally qualified to do closings or some of the acts necessary for closing in the state where the timeshare is located. Sometimes the ''closing company'' is just a wholly owned subsidiary of the seller. You really need an honest and QUALIFIED third party handling closing.

    I have never checked timeshare deeds of other states, but from recorded deeds I have personally seen, most of the multi-state timeshare closing companies regularly prepare and record deeds that are not valid to pass title in North Carolina. The alternative for a buyer is to demand using a lawyer local to the timeshare or carefully research the qualifications of the closing company. The only one I have seen that seems to comply with state laws in all the states it operates in is PCS Holdings. If an eBayer seller balks at your demand to use a legally qualified third party closer, if you are in one of the states where their own closers are violating state law, then threaten to complain both to eBay and more importantly to the Unauthorized Practice of Law division of the State Bar of the state where the timeshare is located. In North Carolina, for example, if one of these jackleg multi-state closing companies does one of its closings for a North Carolina timeshare, they are violating a criminal misdemeanor, and if they charge money for the ''service'' (and of course they do), they are usually also prosecuted for the criminal felony of False Pretenses.

    I am aware that as a result of complaints from one of more HOA's about the funky deeds being recorded by these jackleg multi-state closing companies, the North Carolina State Bar has issued cease and desist letters to many of the multi-state timeshare closing companies. That is a final warning, so they are on a hair trigger. The next complaint against one of them is likely going to result in a felony prosecution. That gives a timeshare buyer a lot of leverage.

    Now, as to Hawaii, I am unaware of what the local law there does or does not allows such a closing company to do. Researching that, however, might give you a whole lot more leverage.
